Question

=Hello Rabbi, I wanted to ask a question regarding downloading Torah pdf’s uploaded online.You may know of many people who upload things online for people to use but, my issue is that I am not sure if I am allowed to use or download it.  I have heard for my personal benefit not to sell it I am allowed to but, the question is more deeper.  I look up online a Talmud that is usually paid for but comes in PDF format from the supplier.  I now find with a google search the PDF for free online uploaded by random people.  Is this allowed?  Is it correct to use someones material when I did not purchase it myself. I also do not know if the person who uploaded it either bought it and uploaded it or stole it then uploaded it.  Most likely since it costs money they bought it first
but I am not sure.  What is the proper thing to do in this situation and is it ok to save some money for the sake of completing the whole shas.  I wanted to use the PDF to study during my free time when I am away from my seferim.  Thank you!

Hello and greetings,

There is a division among the poskim regarding ownership of an intellectual creation that is not a physical creation and whether its reproduction can be prohibited. In fact, the majority of the poskim believe that there is intellectual property ownership over an idea-based creation, and from the standpoint of ownership, copying the software would be prohibited.

The Sephardic Chief Rabbi R. Ovadia Yosef holds the opinion that ownership of an idea-based creation, which is not a physical creation, constitutes intellectual property ownership. According to his view, there is a prohibition on reproducing the software due to ownership.

However, a work that was uploaded to the Internet, the poskim wrote, can be downloaded for personal and non-commercial use, since a work that went online its owners lawfully despair of it was lost in the ‘Zoto shel Yam’.

Also, as I understood, even on the part of Dina Demalkhuta Dina according to the Copyright Law, there is no impediment to the use of conceptual works for personal use that is not for commercial purposes.

Therefore, to the extent that these files are on the Internet for anyone who wants them, you are entitled to download them and use them for personal purposes.
