Question:

Hello Rabbi,

I live in an apartment building with 45 families sometimes UPS provides a package for a non-Jew who lives far away and mistakenly place it in my building, am I allowed to take the item otherwise it may end up in garbage since no one will claim it.

Answer:

Your question is important

A mail shipment usually returns to the sender when not placed at the appropriate address, so if the shipment is placed in a reserved form that you will return to the sender or reach the person to whom it was sent, it is forbidden to take it even though the recipient is a non-Jew, because robbing a non-Jew is also forbidden.

However, if the shipment has not reached its destination and is rolling from place to place, and is in a place that is not reserved, and as you wrote in your question, it will find itself in the trash can, you are entitled to take it, since there is no commandment to return it to the non-Jew. In particular, that it is in a place where most of them are gentiles and sooner or later the shipment will be taken to the trash can or by another person.

Multiple regards

Rabbi David Ohayon

Attention: You should not learn from one case to another, each case must be analyzed individually. Generally speaking, it's always best to have contact with a Rabbi in person, not just virtual contact. Note that where there is a local Rabbi("Mara Deatra"), one should ask him. The answers are under the responsibility of the rabbi who responded, and not under the responsibility of the website and/or the Head of the Institution.
