But he does not want to pay, and he claims he thought that I was studying with him voluntarily, who is right?

: Since this depends on the rabbinical dispute, it is not possible to oblige the father to pay, but it is possible to explain to the father pleasantly, that he wants to do what is good and right in the eyes of Hashem, he is commanded to pay.   Sources
