Question

If a Jewish lesbian gets impregnated by artificial insemination and delivers a baby, what is the child’s identity?

Answer

Hello & Greetings

Your question is very important

In general, an unmarried woman that is pregnant from the sperm of a Gentile, the status of the child is as the mother, that is, a Jew. Whereas, according to Judaism, a Gentile who comes upon a Jewish girl her child follows the mother religion.

However, an unmarried woman that is pregnant from the sperm of a Jew, the child receives the father’s pedigree, so that if the father is a Cohen, the child is also a Cohen.

Regarding your question, I understand that the woman conceived through artificial insemination from a sperm donor from the sperm bank. In this case, since it is a sperm bank abroad, most of the sperm donors there are not Jewish. The status of the child as the status of the mother, as the law of a Gentile who came upon a Jewish girl.

It should be noted that even if a daughter was born from this pregnancy, she is permitted to marry a Cohen, since the pregnancy was conceived through artificial insemination, and not through the coming of a non-Jew’s offense with a Jewish girl.

It is important to add that the very idea of having a child without a father is definitely problematic, and causes a lot of injustice to a child who grows up without a father. This is in addition to the halachic problem and the breach of holiness in the fact that the daughter of Israel becomes pregnant from Gentile.

It should be added that even a woman who thinks she has no sexual attraction to a man, with proper counseling, help and support, find happiness and joy in marriage to a man who can suit her, and establish a wonderful family with him.
