Question:
Hello, sir. I’m taking a college class and I’d like to get your opinion please. The class is on biblical justifications for war and what a “just war” consists of. The pacifist side of the argument starts with the commandment to “not kill” but if I’m not mistaken, the commandment is to “not murder” “. They reference Lamech and whether he was guilty because he killed on accident, the arguments being that he would be innocent if the killing was accidental. Any advice you have for me would be greatly appreciated
Answer:
The Torah ordered us not to kill, this imperative was said to prohibit willful or accidental murder or in any situation under the control of man and could have prevented it.
Even though that’s the imperative, there’s a big division between inadvertent and willful in the matter of the punishment of the person who murdered. The willful killer must die, but the accidental killer does not owe death but exile, [Exodus 21].
Therefore, the answer to your question is this way, Lamech who inadvertently killed is not “guilty,” but he is also not innocent, but he must face the punishment of exile.
The reason why the Torah also imposes punishment on the accidental killing is so that people will warn with double caution not to reach a situation in which they can inadvertently kill.
Although this seems a bit of an injustice, to punish in exile those who inadvertently killed, in the Gemara ‘macot Page 10’, explains an annotated that the Creator rolls a duty by a debtor, that is, causes those who must be exiled to kill inadvertently in order to serve his sentence, but the Creator does not bring an entitled person to involuntary manslaughter.
Good luck wherever you turn
