Question

Our Mom died recently and we received an inheritance. Do we have to pay tithe of the Inheritance? If so, where in the Thora does it say that?

Answer

Hello & Greetings

A tithe is for any money that comes into a person’s possession, even for inheritance money, and although the person that passed away has already gave tithes for those funds that came into your possession. As the Holy Shloh wrote in Tractate Megillah, and brought in the ‘pitchai Teshuva’ יורה דעה סימן רמ”ט סק”א.

The source of the commandment of tithes is the verse in the Torah in Deuteronomy chapter 14, verse 22: shall you give tithe from all the grain of your seed that comes out of the field year after year.

However, there is some controversy as to whether this verse speaks only of tithes of grain or also of tithes of money, some say that the verse also speaks of tithes of money. some say that the verse does not speak of tithes of money, but from our sages there is an obligation to give tithes of money, and some say that tithes are not even a charge from our sages, but a good custom.

Indeed, they all agreed to one thing, that the person who is strict about tithes sees a blessing in all his business and money, and thereby establishes a partnership with God, so much so that God gave permission to examine him, in the mitzvah of tithes, if you do not see a blessing in respect of the mitzvah of tithes.

Happy and blessed New Year wishes
