Question

I am responsible for cleaning on behalf of the building committee. Recently, I took one of the residents’ bicycles outside the building for a thorough washing, and when I came to return them, they had been stolen. Am I required to pay? I should note that I am not responsible for the residents’ belongings at all, even while I am working, and everyone knows this.

 

 

Answer

If the thief is not found, you must pay the owner. Even though you are not a “watchman” for the residents’ belongings, the act of taking them out of the building to an unguarded place [as implied by the circumstances] is considered direct damage, and you should have found a secure place for the washing or watched over the bicycles.

However, if taking them outside the building is not in fact considered an unguarded place, you are exempt under the laws of guardianship, since you did not accept such responsibility upon yourself.
